Terms of Service
Questions about it can go to hello@itsopen.dev.
Effective November 5, 2026
These terms are an agreement between you and Arcaro Labs LLC ("ItsOpen", "we", "us"). They cover the ItsOpen website, dashboard, API, agent API, browser script, status pages and report forms (together, the "Service"). By creating an account, joining an organization or using the Service, you agree to them. If you use the Service for a business, you agree on that business's behalf and confirm you're allowed to.
If your organization signed a separate agreement with us, such as an enterprise contract, that agreement wins wherever it differs from these terms.
Who's who
- Customer (or "you"): the business or person that holds an ItsOpen organization.
- Member: a person on a customer's team who signs in to the dashboard.
- Monitored site: a website, API or other address a customer asks us to check, or adds our browser script to.
- Visitor: someone who uses a monitored site, views a status page or files a report.
The Service
ItsOpen checks your sites from the outside, learns how fast each one usually is, and tells you when something is wrong. Our browser script counts page views, load times, errors and failed requests from your visitors' own browsers, and can record session replays when you turn them on. Visitors can report problems through a widget or your status page, and you can publish a status page for each project. Agents and tools can read all of it through API keys or Sign in with ItsOpen.
We may change, add or remove features over time. If we remove something that materially reduces what you've paid for, we'll tell you in advance where we reasonably can.
Your account
You need an account to use the dashboard. Give us accurate information and keep it current. You're responsible for keeping your sign-in secure, including your password, authenticator and recovery codes, and for everything done under your account.
An organization's owner and its admins decide who joins, what each member can do and who manages billing. You're responsible for your members and for what they do in the Service.
You must be at least 18 to create an account.
What you monitor
Only monitor sites you own or have permission to monitor. You agree that:
- You have the right to check each address you add, and to add our browser script to each site you install it on.
- You tell your visitors about the script, and about session replay if you turn it on, in your own privacy notice, and you get any consent the law where your visitors live requires before recording them.
- You choose what replay leaves out, using the masking options we provide, and you don't turn on replay for pages that collect payment card details, health records or similar sensitive information.
- You respond to your visitors' privacy requests about the data the script collects on your site. We'll help you do it.
Status pages you publish are public, and so is anything you write on them. Don't publish an address on a status page unless you're happy for it to be seen.
Keys, agents and alerts
API keys and apps you approve with Sign in with ItsOpen can read, and if you allow it change, your monitoring. You are responsible for everything done with your organization's keys, including what an AI agent decides to do on its own. Give each key the narrowest scopes and projects it needs, and revoke any you think has been exposed.
When you add an alert channel, such as email, a webhook, Slack, Discord, the Arcaro Labs hub, or a GitHub repository through Operate As, we send your alerts and visitor reports there. What happens to them after that is governed by that service's terms.
Acceptable use
Don't use the Service to:
- Check, probe or load test an address you don't own or have permission to test, or use our checks or the public "is it down?" tool to attack, flood or scan anyone.
- Collect visitors' information without the notice or consent the law requires.
- File false or abusive reports, or use report forms to send spam or harassment.
- Send malware, spam or phishing, or take part in fraud.
- Break the law, or infringe anyone's intellectual property or privacy.
- Probe or test the Service's own security without our written permission, or get around its limits, keys or billing.
- Overload, disrupt or reverse engineer the Service, except where the law lets you regardless of this term.
- Resell the Service, or use it to build a competing product.
Security researchers acting in good faith are welcome to report issues to us at hello@itsopen.dev.
Plans and billing
Free plan. Every organization can use the Free plan, which needs no card and has the limits shown on our pricing page. You can choose a paid plan at any time.
Subscriptions. Paid plans are billed monthly or yearly in advance, and renew automatically until you cancel. Each plan sets limits, such as how many monitors and members you can have and how often each is checked. Prices and limits are shown on our pricing page and when you subscribe. Payments are processed by Stripe, and you agree to its terms when you pay.
Trials. If a plan offers a free trial and it ends without a subscription, checks pause until someone in the organization chooses a plan. Your monitors and their history are kept.
Changes. Upgrades take effect right away and are prorated. Downgrades take effect from your next billing date.
Cancelling. You can cancel from Billing in your dashboard at any time. Your plan keeps working until the end of the period you've paid for, and you aren't charged again. Payments are non-refundable, except where the law requires a refund.
Failed payments. If a payment fails, we retry it over the next few days. If it still can't be collected, we may pause your organization until it's paid.
Taxes and prices. Prices don't include taxes, which you're responsible for unless we collect them. We may change our prices. We'll tell you at least 30 days before a change affects your subscription, and it applies from your next renewal.
Your data
You keep all rights to the data you put into the Service, and to the data our script and report forms collect on your sites. You give us permission to host, store, copy, transmit and process it only as needed to run, secure and support the Service for you, and as described in our privacy policy. For your visitors' data, we act on your behalf and follow your instructions, which are your use of the Service and its settings.
We don't sell your data or your visitors' data, and we don't use either to train AI models.
If you send us feedback or suggestions, we may use them without owing you anything.
Our property
The Service, including its software, design and documentation, belongs to us and our licensors. While you follow these terms, we give you a limited, non-exclusive, non-transferable right to use it. Our names and logos are ours. Please don't use them without asking, except to describe accurately that you use ItsOpen.
Suspension and termination
You can stop using the Service and delete your organization or account at any time from your dashboard.
We may suspend or end your access if you break these terms, if your use puts the Service, our other customers or anyone you monitor at risk, if payment is overdue, or if the law requires it. Where it's reasonable and allowed, we'll tell you first and give you a chance to fix the problem.
When an organization is deleted, its monitors stop, its status pages go offline and its keys stop working. Some records, such as the activity log and billing records, are kept for the periods in our privacy policy. Sections that by their nature should survive termination, including those on fees owed, data, disclaimers, liability and indemnity, will survive it.
Disclaimers
We work hard to check your sites accurately and alert you quickly. Even so, checks can miss an outage, report one that isn't real, or arrive late, and the Service itself can be unavailable. The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. Uptime figures and anomaly alerts are for information: they aren't a guarantee of your own service's availability, and you shouldn't rely on ItsOpen as your only way of knowing your sites are working. Your plan's terms may include an uptime commitment for ItsOpen itself; if so, that commitment applies to you.
Limitation of liability
To the fullest extent the law allows:
- Neither party is liable to the other for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, even if told they were possible. This includes losses from an outage we didn't detect or an alert that arrived late.
- Each party's total liability arising from or relating to these terms or the Service is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or US$100.
These limits don't apply to your payment obligations, to either party's indemnity obligations, or to liability that can't be limited by law.
Indemnity
You'll defend and indemnify us against claims, losses and costs, including reasonable legal fees, brought by a third party (including one of your visitors, or the owner of an address you monitored) that arise from your use of the Service in breach of these terms, from monitoring or collecting data without the permission, notice or consent the law requires, or from what your agents or code did with your keys.
Changes to these terms
We may update these terms. If a change is material, we'll tell you by email or in the dashboard at least 30 days before it takes effect, unless it's needed sooner for legal or security reasons. If you keep using the Service after a change takes effect, you accept the new terms. If you don't agree, you can cancel before then.
Governing law
These terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict of law rules. Any dispute will be heard in the state or federal courts located in New Jersey, and both parties agree to their jurisdiction.
General
These terms are the whole agreement between us about the Service. If a part is found unenforceable, the rest still applies. Not enforcing a term isn't a waiver of it. You may not assign these terms without our consent, except to a successor of your whole business; we may assign them to an affiliate or a successor. Neither party is liable for delays caused by events beyond its reasonable control. Notices to you go to your account's email address; notices to us go to hello@itsopen.dev.
If you're a visitor
If you're using a site that runs ItsOpen, viewing a status page or filing a report, you don't need an account. The site's owner decides whether to use ItsOpen and is responsible for telling you about it. When you file a report, write only what's needed to describe the problem, and don't include passwords or other secrets. How we handle your information is covered in our privacy policy.
